Thereafter, during the pendency of cause number 94792, the Talbots insurance carrier, Factory Mutual Ins. Co. (hereinafter referred to as Factory Mutual) was repeatedly requested to take over the defense of the lawsuit for the Talbots. It refused and a judgment was entered on June 18, 1970, in favor of the plaintiff and against the defendants, Ruth and Warren Talbot, in the sum of $150,000. That judgment specifically found that all the allegations of the plaintiffs complaint were true and "that Ruth W. Talbot and Warren J. Talbot owned, provided, controlled, furnished and/or maintained the automobile for their minor daughter who was driving said automobile at the time of the accident."
